Promise Package Terms and Conditions

  1. APPROVAL/EFFECTIVE DATE:  This Agreement shall become effective upon the approval of PCP LLC. (PCP), which approval shall be deemed granted TEN (10) days after receipt by PCP of a fully-executed copy of the Agreement with payment.
  2. Our office hours: Regular hours are Monday-Thursday 9am-6pm. We request that your student find time in their busy schedule to accommodate these hours. We have on-line meetings available during these hours to help with this.
  3. Engagement:  PCP provides you with the information and services described here within. We do change our program from time to time and may offer you additional services. In order to get the most from our services, your family needs to participate in the college process. Furnishing necessary information and documents in a timely manner is necessary in order to access and process the PCP services. Once the above services are completed, our services will terminate with one exception: you are free to contact us with college related questions until your student finishes his/her first year of college. In the meantime, we will not take any further actions with respect to your affairs unless and until we hear otherwise from you. It is important that you understand that the information we provide to you is based on general public information. We will of course use ordinary and professional skills in performing our services under this agreement, but we do not guarantee the results of our services. The decision whether and how to implement the information we provide to you is entirely yours.
  4. DISCLAIMER:  PCP is NOT a scholarship search company.  PCP does NOT guarantee a student’s college enrollment or funding eligibility.  The role of PCP is to assist the student and family with the college preparation and funding process.  There are several factors such as family participation; the student’s academic and extracurricular achievements and the student’s higher educational goals, for example, that will produce a variance in results from student to student. In providing services, PCP does not discriminate on the basis of race, color, sex, age, religion, national origin, or disability.
  5. Limitation of Scope of Services:  The PCP services are not designed, and should not be relied upon, as a substitute for your own financial judgment nor are they meant to eliminate the necessity of an ongoing review of your personal financial situation. Rather, the PCP services are designed to supplement your own planning and analysis, and to aid you in fulfilling your college financial planning objectives. In addition, the PCP services are not designed to discover fraud, irregularities, or misrepresentations made in materials and information provided to us. The PCP advisor and its affiliates do not have, nor do they claim to have sources of inside or private information. The recommendations developed by PCP are based upon the professional judgment of PCP and its individual advisory affiliates and neither PCP nor its affiliates can guarantee the results of any of their recommendations.  The client at all times shall elect unilaterally to follow or ignore completely, or in part, any information, recommendation, or advice given by PCP under this service agreement. We do not verify or check financial data that you supply to us. We are not responsible for the results of any inaccurate data. College planning is not an exact science; we cannot guarantee that you will achieve specific results. PCP does not provide accounting or legal advice. Client is urged to work closely with his/her accountant and attorney in implementing the recommendations contained in the PCP college plan. PCP will not be responsible for the acts or omissions or insolvency of any agent, broker or independent contractor selected to take action or to negotiate or consummate any transaction for the clients account.  The PCP services also do not include other services, such as, but not limited to:
    1. Tax compliance services, including tax preparation
    2. Accounting and auditing services
    3. Legal documents such as pension plans, wills, trusts, and other agreements and contracts
    4. Review and analysis of the investment materials, and prospectus not directly related to college funding
    5. Any other services not specifically outlined herein.
  6. NOTICE OF CHANGE OF ADDRESS:  Buyer shall inform PCP of any change of residence or mailing address within THIRTY (30) days from the date of the change.
  7. SUCCESSORS:  This agreement shall be binding upon the heirs, successors, and assigns of the parties.
  8. ENTIRE AGREEMENT: This Agreement and PCP, “PARROS COLLEGE PLANNING PROMISE PACKAGE SERVICE GUARANTEE”, constitute the entire agreement between the parties, and are a fully integrated expression of their intent.  There are no other agreements between the parties, expressed or implied, oral or written.
  9. DISPUTE RESOLUTION:  Any claim or cause of action arising out of this Agreement must be filed with a court of competent jurisdiction within ONE (1) year from the FIRST (1st) day of September of the Student’s First Year of College and any cause of action for breach of this Agreement not so filed within this period of time is waived.  The venue for any litigation to enforce this Agreement shall be the State of Michigan.  This contract shall be governed by the laws of the State of Michigan and any applicable federal laws and regulations.
  10. LIMITATION OF DAMAGES:  Recovery for any claim of Buyer arising out of this Agreement shall not exceed amounts paid by the Buyer to PCP.
  11. ATTORNEY’S FEES:  In the event that either of the parties to this Agreement is required to commence collection proceedings or litigation to enforce the terms of this Agreement, the prevailing party in such litigation shall be entitled to an award of reasonable attorney’s fees, expert witness fees, and other costs incurred in such proceedings or litigation.
  12. Privacy Policy:   Certified College Planning Specialists, like all providers of personal financial services, are required by law to inform their clients of their privacy policies regarding client information. PCP has been and continues to be bound by professional standards of confidentiality that are even more stringent than those required by law. Therefore, we have always protected your right to privacy.
    Parties to Whom We Disclose Information: For current and former clients, we do not disclose any nonpublic personal information obtained in the course of our practice except as required or permitted by law. Permitted disclosures include, for instance, providing information to our employees, and in limited situations, to unrelated third parties who need to know that information to assist us in providing services to you. By signing this document you are giving us authorization to release information on your behalf. In all such situations, we stress the confidential nature of information being shared.
    Protecting the Confidentiality and Security of Current and Former Clients’ Information: We retain records relating to professional services that we provide so that we are better able to assist you with your professional needs and, in some cases, to comply with professional guidelines. In order to guard your nonpublic personal information, we maintain physical, electronic, and procedural safeguards that comply with our professional standards.

NOTICE TO BUYER

THIS AGREEMENT IS BINDING UPON YOU.  YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENT ARE JOINT AND SEVERAL. A CANCELLATION FEE EQUAL TO THE TOTAL OF ANY REMAINING BALANCE WILL BE CHARGED IF THE ENROLLED FAMILY CHOOSES TO TERMINIATE THIS AGREEMENT PRIOR TO THE ENTIRE INITIAL ENROLLMENT FEE BEING PAID.  INITIAL ENROLLMENT FEE IS DEFINED AS THE TOTAL AMOUNT DUE FOR SERVICES PERFORMED AND/OR OFFERED FROM THE ORIGINAL ENROLLMENT DATE UNTIL THE FIRST OF SEPTEMBER OF THE STUDENT’S FIRST YEAR OF COLLEGE.
